Terms of Service
This Terms of Service Agreement (the "Agreement") outlines your access to and use of certain products, services, and properties offered by NFT Fusion s.r.o. (hereinafter referred to as "Company," "We," or "Us"). Our offerings include, but are not limited to, services that facilitate the purchase, storage, and transfer of non-fungible tokens (NFTs) and associated software (collectively referred to as the "Service").
Important Notes
NOT A BROKER OR FINANCIAL INSTITUTION
We are not a broker, financial institution, or creditor. Our role is to facilitate NFT transactions on behalf of users related to the purchase, storage, and sale of these tokens. You acknowledge that if you utilize the Service to buy an NFT, the platform or third-party seller originally offering that NFT (the "Original Offeror") will be an intended third-party beneficiary of this Agreement. Consequently, we are not liable for any disputes arising between you and any Original Offeror regarding such NFTs or their classification as investment contracts or intellectual property rights.
YOUR RESPONSIBILITY
You are solely responsible for verifying the identity, legitimacy, and authenticity of any NFTs purchased through the Service. We make no claims regarding the identity or legitimacy of NFTs you may acquire through our platform.
AGREEMENT EFFECT
This Agreement is significant and affects your legal rights. By clicking "I Accept," completing payment, purchasing items through the Service, or using the Service in any manner, you agree to abide by this Agreement and all terms herein. If you disagree with this Agreement, you are not permitted to access or utilize the Service or purchase any NFTs. For existing users, this Agreement becomes effective upon your first access or use of the Service.
DATA COLLECTION CONSENT
By submitting data through the Service, you consent to the collection, use, and disclosure of your personal data per this Agreement.
RIGHT TO MODIFY
We reserve the right to amend this Agreement at any time at our discretion. Any changes will be communicated via email, notices on the Service, or updates to the "Last Updated" date. Continued use of the Service after such modifications confirms your acceptance of the revised terms. You are encouraged to review this Agreement regularly to understand the applicable terms.
The Service
The Service is a software application enabling users to engage in transactions to purchase NFTs using fiat currency (referred to as a "Transaction").
Payment Data Protection and Disclaimer
We are committed to safeguarding your payment data's security and confidentiality. Your payment information will be processed according to relevant data protection laws and industry standards. However, we are not liable for unauthorized access to or use of your payment information by third parties. By using the Service, you release us from any liability arising from third-party use of your payment data.
Customer Due Diligence (Know-Your-Customer Procedures)
The Company may require you to provide necessary information and documents to comply with applicable laws, including anti-money laundering regulations. We may pause or cancel your Transactions until the requested information is reviewed and accepted.
Warranties and Representations
5.1. All information you provide to the Company is accurate and complete. None of you, your affiliates, or any person for whom you act is associated with prohibited parties as defined by OFAC or subject to international sanctions.
5.2. You are knowledgeable in buying, selling, or trading NFTs and have independently assessed the risks involved.
5.3. You have not violated any applicable laws regarding blockchain technologies or NFT transactions. You are responsible for any equipment and software needed to access the Service.
Purchasing an NFT
To purchase an NFT through the Service, you must provide a valid payment method, such as a credit or debit card. Once your payment method is authorized, you may engage in Transactions. You are responsible for maintaining accurate payment information.
When using the Service to buy an NFT, you acknowledge that the Company will process the Transaction by charging your selected payment method and delivering the purchased NFT to you. The Company may require additional information if there are concerns about illegal activities or inaccuracies in the information provided.
If the Company cannot complete your Transaction for any reason, the order will be rejected, and you will be notified. All NFT purchases are final, non-refundable, and non-reversible.
Pricing
All pricing and fees will be specified at the point of sale. By using the Service, you agree to pay all applicable fees. The Company reserves the right to change pricing at any time, and you will be informed of applicable fees before authorizing a Transaction.
Risks Related to NFTs
You acknowledge that the value of digital assets is highly volatile, and prices can fluctuate significantly. You are responsible for determining any applicable taxes for NFT transactions. NFTs exist solely based on the ownership record maintained on the supporting blockchain. The legal framework governing blockchain technologies is uncertain, and new regulations may impact the Service.
Termination / Suspension
Any party may terminate this Agreement with one month's notice. The Company reserves the right to suspend or refuse services if it believes you are in violation of the Agreement or involved in fraudulent activity.
Amendments to the Terms
The Company can unilaterally amend these Terms and will notify you of any changes. If you disagree with any amendments, you may terminate the Agreement with 30 days notice.
Confidentiality and Data Protection
Both parties agree to protect each other's confidential information. The Company ensures the safety of cardholder data during transactions. Messages sent via email may be used as evidence in disputes.

Liability of the Parties
Each party is responsible for losses incurred due to violations of the Terms. The Company is only liable for direct damages caused by significant breaches of the Terms.
Refund Policy
ALL PURCHASES ARE FINAL. NFTs are digital items, and once minted and linked to your wallet, the transaction cannot be reversed. No returns, exchanges, or refunds are allowed. Users may sell NFTs to third parties after the initial purchase.
Miscellaneous
This Agreement constitutes the entire understanding between the parties. If any provision is found invalid, the remaining provisions will remain in effect. The Terms are governed by Czech law, and any disputes will be handled accordingly.
